Terms of service

These Terms of Service ("Terms") govern your use of the website at konina.studio (the "Site") and the purchase of any products from KONINA. By using the Site or placing an order, you agree to these Terms in full.

The Site is operated by KONINA, a sole proprietorship (eenmanszaak) registered in the Netherlands.

2. DEFINITIONS
"Customer" means the individual placing an order through the Site. "Order" means a request to purchase one or more products as displayed on the Site. "Agreement" means the contract of sale formed between KONINA and the Customer in accordance with these Terms.
3. PRODUCT INFORMATION AND ACCURACY
Photographs and visual representations of products on the Site are provided for illustration only. Slight variations in colour, finish, dimensions, and weight may occur and are inherent to handcrafted production. Such variations do not constitute non-conformity. KONINA takes reasonable care to ensure that product descriptions and prices are accurate, but does not warrant that all information on the Site is free from errors or omissions.
4. FORMATION OF THE AGREEMENT
The display of products on the Site is an invitation to treat and not an offer. An Order placed by the Customer constitutes an offer to purchase. The Agreement is formed when KONINA confirms acceptance of the Order by sending a confirmation email. KONINA reserves the right to refuse any Order, including in cases of suspected fraud, errors in product description or pricing, or stock unavailability.
5. PRICING
All prices are displayed in euros (EUR) and include applicable Dutch value-added tax (BTW), where required. For orders shipped outside the European Union, VAT is removed at checkout, and any customs duties and import taxes are the responsibility of the Customer.
For Customers in markets where prices are displayed in a currency other than EUR, the price shown is a converted equivalent of the base EUR price at the time of the visit, calculated using a third-party exchange rate. The final binding price is the amount confirmed at checkout.
KONINA reserves the right to change prices at any time. The price applicable to an Order is the price displayed at the time the Order is placed. Obvious typographical or pricing errors do not bind KONINA.
6. PAYMENT
Payment is due in full at the time the Order is placed. Accepted payment methods are displayed at checkout and may include credit and debit card, iDEAL, Bancontact, Apple Pay, Google Pay, and PayPal. KONINA does not store payment card information; all transactions are processed by PCI DSS-compliant payment providers.
7. DELIVERY
Delivery terms, timelines, and costs are set out in our Shipping Policy, which forms part of these Terms. Risk in the products passes to the Customer upon delivery.
Customers should inspect packages upon arrival and notify KONINA within 48 hours of receipt in case of visible damage to the package or missing items, by email to support@konina.studio. Latent defects not visible at the time of delivery remain covered under the warranty set out in Section 9 below.
All Orders are intended for the personal use of the Customer. Resale of products purchased from KONINA, in whole or in part, is not permitted without prior written consent.
8. RIGHT OF WITHDRAWAL
You have the right to withdraw from this Agreement within 14 days of receiving your Order, without giving any reason. The conditions and procedure for exercising this right are set out in our Refund Policy, which forms part of these Terms.
9. CONFORMITY AND WARRANTY
KONINA delivers products that conform to the Agreement, are of satisfactory quality, and are fit for ordinary use. In accordance with European Union law, products carry a minimum statutory two-year warranty against lack of conformity. If a product does not conform, the Customer is entitled to repair, replacement, a price reduction, or termination of the Agreement, in accordance with applicable consumer law.
In accordance with Article 7:23 of the Dutch Civil Code (Burgerlijk Wetboek), the Customer must notify KONINA of any non-conformity within a reasonable period after discovery. A notice given within two months of discovery is in any event considered timely.
Slight variations in colour, finish, or dimensions are inherent to handcrafted production and do not constitute non-conformity.
10. INTELLECTUAL PROPERTY
All content on the Site, including text, photographs, designs, logos, and trade names, is the property of KONINA or its licensors and is protected by copyright, trademark, and other intellectual property laws. No part of the Site may be reproduced, distributed, or used commercially without prior written consent. Personal, non-commercial browsing is permitted.
11. LIABILITY
To the maximum extent permitted by law, KONINA's aggregate liability arising out of or in connection with any Order is limited to the value of that Order. KONINA is not liable for indirect, incidental, or consequential losses, including but not limited to loss of profits, loss of data, or loss of opportunity. Nothing in these Terms limits liability that cannot lawfully be limited or excluded under Dutch or European Union consumer law.
12. FORCE MAJEURE
KONINA is not liable for any failure or delay in performance arising from causes beyond its reasonable control, including but not limited to natural disasters, carrier disruptions, government actions, and supply chain interruptions.
13. PRIVACY
Personal data submitted to the Site is processed in accordance with our Privacy Policy, which forms part of these Terms.
14. RELATIONSHIP WITH SHOPIFY
KONINA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with KONINA. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KONINA, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with KONINA.
15. CHANGES TO THESE TERMS
KONINA may update these Terms from time to time. The version applicable to your Order is the version in force at the time the Order is placed. Updated Terms are effective from the date they are published on the Site.
16. GOVERNING LAW AND DISPUTES
These Terms and any Agreement are governed by the laws of the Netherlands. Disputes will be submitted to the competent court of Amsterdam, without prejudice to the Customer's right to bring proceedings before a court in their country of residence under mandatory consumer protection law.
The European Commission provides an Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr. Customers may use this platform to resolve disputes out of court.
